The term “custody violation” is often confused with or equated to a breach of supervisory duty, but it encompasses much more and can take various forms. Custody does not only mean ensuring that nothing happens to the child, but also that the child behaves socially appropriately, is properly cared for (food, clothing), remains healthy, attends school regularly (compulsory education), and has sufficient free time for personal activities. Attending to the child’s needs and abilities is the responsibility of both parents – both the parent with whom the child lives and the parent who has visitation rights.
But what if you suspect that your ex-partner is not acting responsibly or lovingly toward the child, or may even be abusive? Mere suspicion is, of course, insufficient to convince a court – you need concrete, legally admissible evidence.
